Understanding Guardian ad Litems in Missouri

In Missouri, a Guardian ad Litem (GAL) is a court-appointed attorney appointed to represent the best interests of a child or incapacitated person in legal proceedings. Their role is crucial in ensuring that the voices of vulnerable individuals are heard and considered in legal matters.  This could be in a divorce, paternity, order of protection, or guardianship case. 


What Does a Guardian ad Litem Do?

A GAL's primary responsibility is to advocate for the child's best interests, which may not always align with the child's expressed wishes. Their duties include:

  • Investigating the Child's Circumstances: Conducting interviews with the child, parents, teachers, healthcare providers, and others involved in the child's life.
  • Reviewing Relevant Records: Examining school, medical, and social service records to understand the child's needs and environment. 
  • Attending Court Hearings: Participating in hearings to present findings and recommendations to the court. 
  • Making Recommendations: Advising the court on custody, visitation, and other matters affecting the child's welfare.
  • Advocating for the Child's Needs: Ensuring that the child's best interests are prioritized throughout the legal process.

When Is a Guardian ad Litem Appointed?

Under Missouri law, a GAL must be appointed in the following situations:

  • Child Abuse or Neglect Cases: When allegations of abuse or neglect are made. 
  • Adoption Proceedings: In all cases where the person sought to be adopted is under eighteen years of age.  

Additionally, a GAL may be appointed in cases involving contested child custody, visitation, or support issues. 


Who Can Serve as a Guardian ad Litem?

In Missouri, GALs are licensed lawyers who have completed specialized training in GAL duties.
To become a certified GAL, attorneys must complete an initial 8-hour training session, followed by 3 hours of continuing education annually.

 

How Are Guardian ad Litem Services Funded?

GAL fees are typically divided between the parties involved in the case. In many instances, the court will order each party to pay an equal share. However, the court may adjust this allocation based on factors such as each party's financial situation or conduct during the proceedings. In cases involving child abuse or neglect, courts are prohibited from making victims pay GAL fees. 


How to Get a Guardian ad Litem in Missouri

A GAL is usually appointed by the court during legal proceedings involving child welfare. In some cases, either party may request the appointment of a GAL. For instance, in many counties in Missouri, attorneys interested in serving as GALs must submit an affidavit to the Family Court. The court maintains a list of approved GALs from which appointments are made.
